General terms of manufacture and supply
1. Identity and scope
Mad Music Vinyl Factory S.L., Spanish tax ID B88614771. Address: C/ Rafael Pillado Mourelle 25, nave 6, 28110 Algete, Madrid, Spain. Contact: info@madvinylmusic.com; +34 696 03 31 38. These terms are intended to govern vinyl record manufacture and supply and the components included in each quotation. The scope of each edition will be described in the quotation and order documents.
Registered with the Commercial Register of Madrid, volume 40381, book 0, folio 20, section 8, company sheet M-717305, entry 1.
2. Quotation validity and order acceptance
Quotations are valid for 30 calendar days from issue unless another period is expressly stated. After this period, an order not yet formalised requires an updated quotation.
The customer may accept by email identifying the quotation reference. The quotation will expressly state that acceptance includes these general terms, with a direct link and the applicable date or version, so that the customer can read and save them beforehand.
The order is formalised when Mad Vinyl confirms acceptance of the work in writing, recording the agreed specifications and payment terms. Accepting the quotation does not itself reserve a manufacturing or delivery date. Scheduling depends on production availability, receipt of the necessary materials and compliance with the agreed payment terms. Changes to quantities, specifications or services require written agreement and may require an updated quotation.
3. Editions and specifications
The minimum order is 100 copies. Manufacture follows the agreed quotation. Available formats are 12-inch at 140 or 180 g, 10-inch at 95 g and 7-inch at 42 g, with a large or small centre hole for the latter. All formats are offered at 33 and 45 rpm. The specific configuration must be recorded in the order. Black, coloured and mixed-effect vinyl and different sleeves and finishes are available; special combinations require individual availability and feasibility checks.
The final quantity supplied may vary by up to 10% above or below the agreed quantity, capped at 50 units for orders up to 5,000 units and 100 units for orders exceeding 5,000. The lower of the percentage limit and unit cap always applies. The final amount is adjusted to units actually supplied: additional copies are charged and missing copies deducted at the agreed quotation prices. Undelivered production rejects are not charged as supplied units.
Coloured and effect records may differ in shade, distribution and appearance between copies and from reference images, while retaining the agreed combination. Each record may weigh up to 10% above or below the agreed nominal weight. These tolerances do not constitute acceptance of defective records or limit mandatory conformity rights.
4. Audio and artwork
The customer must provide audio mastered for vinyl. Mad Vinyl assumes supplied audio has been prepared for this medium; receipt does not include automatic audio review or mastering. Audio review is available on request and mastering requires a quotation accepted in advance. The review’s scope and any applicable price are agreed beforehand.
Accepted audio formats: WAV or AIFF, 16, 24 or 32 bits, at 44.1, 48, 88.2, 96, 176.4 or 192 kHz. The minimum is 16-bit/44.1 kHz; artificially increasing resolution is unnecessary. Artwork must be consolidated in Mad Vinyl templates as Adobe PDF 1.3 using Coated FOGRA39 or ISOCoated_v2. Artwork proofs require the customer’s express email approval before printing.
Files may be delivered through WeTransfer, email or Mad Vinyl’s file manager. Track titles and running times are required. The customer may resupply corrected files. Any additional correction work by Mad Vinyl requires a quotation and customer acceptance before it is carried out.
5. Rights in the content
By accepting the quotation, the customer declares that they hold the rights and permissions required to reproduce and manufacture the supplied audio, artwork, trademarks and other materials. If there is doubt, Mad Vinyl may request supporting documentation. Work affected by indications of infringement will be suspended until the matter is clarified. Manufacture does not transfer content rights to Mad Vinyl or automatically authorise promotional use. Any promotional use of audio or artwork requires the relevant permission. These obligations do not provide a general exemption from either party’s legal responsibilities.
6. Test pressings and approvals
Mad Vinyl offers and recommends test pressings before manufacturing the edition. The offered option comprises five black copies, with more available on request; the quotation specifies the quantity and inclusion. Listening to every copy on different systems is recommended. Production proceeds after customer approval as agreed. Approval must be expressly given by email; silence is not approval. Manufacture without test pressings is possible upon the customer’s express written request, without waiving mandatory conformity rights.
After cutting, audio can only be changed through a new cut. Work repeated because of a customer-requested audio change is quoted and charged subject to prior acceptance. Test pressing issues must be reported by email with side, track, time and a description. Mad Vinyl may request a recording or return of copies for investigation. The production run remains on hold until the issue is resolved and express email approval received. Confirmed manufacturing defects will be corrected and the necessary tests repeated without additional customer cost. Creative or audio changes requested by the customer are quoted separately.
7. Manufacture and quality control
Weight is checked during pressing, every record is visually inspected and listening checks are performed by sampling. Rejected units are separated and the plastic recycled where possible. No more than 1,000 copies are pressed using the same pair of stampers. Packaging components are checked before sleeving and dispatch. Manufacturing records and test pressings are retained for quality follow-up. These controls do not replace legal obligations or establish an accepted defect percentage.
8. Prices, taxes and payment
Quotation prices exclude taxes and shipping, which are detailed separately as applicable. Applicable amounts and the total will be communicated before contracting. Consumers will receive the total-price information required by law. Payment is by bank transfer: 50% upon formalising the order and the remaining 50% before delivery. Work starts after receipt of the deposit and materials needed for the relevant phase, in accordance with the communicated schedule. The balance must be paid before dispatch or collection at the factory. Exceptional payment terms must be agreed in writing and included in the quotation.
9. Timing, changes and cancellations
Lead times begin upon receipt of the deposit, valid files and approvals required for the relevant phase. Test pressings will be available approximately three weeks after those requirements for their manufacture are met, excluding transport to the customer. The final production schedule is communicated according to the edition and production planning once the required materials and approvals, including test pressing approval where ordered, have been received. Delivery dates are estimates; customers should check the project forecast before setting a release date. Missing valid materials or delayed customer approvals lead to rescheduling according to availability when requirements are complete.
Third-party delays not attributable to Mad Vinyl may affect forecasts, without excluding Mad Vinyl’s applicable legal responsibilities for suppliers or other parties involved in fulfilment or limiting mandatory customer rights. Mad Vinyl will inform the customer of its own management or production delays and provide an updated forecast; effects of third-party delays will be reported once sufficient information is available.
If the customer cancels, completed work and ordered materials that cannot be recovered will be settled. Mad Vinyl will itemise these costs and refund any deposit exceeding them, without prejudice to mandatory rights. Changes to quantity, colour, packaging or other specifications are subject to feasibility review; costs and revised timing are communicated and agreed in writing before execution.
10. Delivery and transport
Worldwide shipping and factory collection are available. Freight is quoted separately using the address and postcode; shipping quotations exclude taxes and customs charges, which must be clarified for the destination. Factory visits must be arranged; they do not grant unrestricted access. Mad Vinyl books transport unless the customer arranges collection or appoints their own carrier.
Mad Vinyl shipments include the transport service’s basic goods insurance. This is not represented as all-risks insurance or guaranteed compensation for the full order value; coverage and limits depend on the policy and service. For loss or damage, the customer must notify Mad Vinyl and also make the claim applicable to them with the carrier, providing information and documents. Mad Vinyl opens and handles its own carrier claim. Customer cooperation does not replace Mad Vinyl’s obligations or limit mandatory rights.
Partial deliveries are allowed after notification to logistics. Terms and freight costs are communicated before each dispatch. Multiple-address shipments require confirmation of arrangements and costs and are not assumed included. Outside the EU, the customer handles import formalities, taxes and customs duties unless otherwise agreed in writing, subject to each party’s legal obligations.
Extended insurance may be requested, subject to availability, prior quotation and acceptance before dispatch. Visible damage must be noted on the delivery receipt and photographed with packaging and goods. Packaging and damaged units must be kept until investigation ends. Carrier instructions and claim deadlines depend on the booked service and will be communicated; they do not reduce mandatory rights or deadlines against Mad Vinyl.
11. Quality issues and conformity
Quality issues should be emailed to info@madvinylmusic.com with order reference, affected quantity and description within 30 calendar days of receipt of the affected goods. Depending on the issue, Mad Vinyl may request photos, videos, physical samples or a combination. Following investigation, replacement, repair where possible or a credit will be offered according to the defect and circumstances, respecting mandatory remedies and rights. The 30-day reporting period is for commercial handling and does not shorten statutory periods or exclude mandatory rights for non-conformity or defects appearing later.
12. Surplus materials
Available surplus jackets, labels, inner sleeves, inserts, booklets, boxes and stickers are sent to the customer for replacement in case of transport damage. Mad Vinyl does not store them for reorders. This does not replace claims handling or limit customer rights.
13. Business customers and consumers
Business or consumer status depends on the purpose of the transaction, not simply on being an artist, self-employed person or individual. No clause intends to limit mandatory rights.
14. Acceptance, applicable law and disputes
These terms will be available on the website. Each quotation will include a direct link and applicable date or version, expressly stating that accepting the quotation also accepts those terms. The customer can read and save them before acceptance. Mad Vinyl will retain the quotation, a copy of the referenced terms, the acceptance email and order confirmation together. Subsequent price, specification or timing changes are agreed and recorded by email. Later website updates do not themselves amend an existing order. Spanish law and applicable mandatory rules apply. Courts have jurisdiction as determined by law; these terms impose no exclusive territorial forum.
